Mullet Bay settlement
St. Maarten--The Government of St. Maarten applauded on Thursday the reported impending solution to the SunResorts-Mullet Bay Apartment Owners conflict and said it looked forward to being able to sit and discuss with the developer its “plans as part of the development plan for the larger Lowlands/Cupecoy area.”
The government’s position was outlined in a statement issued by Leader of St. Maarten Government Commissioner Wescot-Williams Thursday night.
In that statement Wescot-Williams said that while she was in no way claiming to have sufficient details to judge the proposed settlement on all its merits, “the government of St. Maarten is convinced that both parties in arriving at this proposed settlement have thoroughly considered the reasonableness and fairness of it to all.”
She continued: “At the start of the Mullet Bay development in the early ’70s, an innovative investment plan was devised, allowing individuals to invest in and own apartment units on the property.
“It is this investment model, however, that in the end took 11 nightmarish years to conciliate the rights of the apartment owners versus those of the property owners.
“The government of St. Maarten wishes to thank the individual apartment owners for their confidence in St. Maarten many years ago and their patience with the protracted litigation between parties since the property was destroyed in 1995.”
She said many of the affected Mullet Bay apartment owners had continued to come to St. Maarten year after year, encouraging their offspring, many of whom were toddlers when the original investments were made in Mullet Bay Resort, to do likewise.
And, noting that some of these repeat visitors owned timeshare at other resorts in St. Maarten, she said Government “can only but encourage all parties to give their support and approval to the proposed solution, paving the way for the redevelopment of the property in question.”
She said the government of St. Maarten looked forward to sitting with the developer and discussing these plans as part of the development plan for the larger Lowlands/Cupecoy area, “once a solution is accepted and ratified.”
