Executive Council to court
PHILIPSBURG--Emilio Wilson BV has started a legal procedure according the Federal Ordinance Administrative Law LAR against the Executive Council for not granting a planning permit for the development and construction of 165 houses on Emilio Wilson Estate. The company is also preparing a procedure claiming damages from the Executive Council and individual authorities for losses suffered.
In a press release issued yesterday Emilio Wilson BV stated that it found the attitude of the Executive Council misleading. The company said it had been approached by the Executive Council and its Commissioner of Environmental Development and Property Management to invest in the development of a residential area in St. Maarten.
“After the company purchased Emilio Wilson Estate and presented its plans to the Executive Council, they were received with much enthusiasm by the Executive Council. However, when the time came that the planning permits had to be issued the government succumbed to public pressure regarding possible damage that could be caused to the historical value of the estate,” the press release states.
According to Emilio Wilson BV, the Executive Council has been silent on the matter since then and simply doesn’t want to speak to the developers. That’s why legal steps are being taken to obtain the needed planning permits via court and to file a claim against the government and individual government members for losses suffered.
The plans are to build 165 houses, but to preserve the historical value of the estate, according to the developers. There will be no construction above a height of 200 meters, Emilio Wilson Cultural and Historical Park will be fitted into the new to-be-developed residential area as much as possible, the plantation house and the park will be renovated and the slave walls will be reinstated in their full glory.
