CUPECOY--University Drive, the access road to American University of the Caribbean (AUC) Medical School, belongs to SunResorts, claims Clarence Derby, Manager of Mullet Bay Resort and The Towers at Mullet Bay, holdings of SunResorts.
Controversy over ownership and right of use of the road that runs parallel to Atlantis Casino erupted publicly two weeks ago, when government tore down a wall AUC management had built at the university’s entrance to protect students from speeding motorists heading to other adjoining properties.
AUC Chancellor Dr. Paul S. Tien claims ownership of the road, while Derby added his voice contradicting this on Friday. Derby said Tien had never bought the land from SunResorts and the original access road to the three parcels of land purchased by Tien in 1998 and other surrounding properties, including The Towers and Treasure Island, ran through the Mullet Bay golf course, past the 14th fairway.
For the safety of the students and golfers, an agreement was reached between SunResorts and Tien for the former to provide an easement to the new university campus where University Drive is now, Derby said. Tien was also charged with paving and maintaining the road, he added. The two entities are in court battling over several issues related to the use and placement of the easement.
Derby added that Tien had never sought permission to build the high sidewalk along the road, a part of which was torn down by Atlantis Casino last week to create an exit for vehicles from the complex.
At present, access to and use of University Drive are entangled in three separate court battles: SunResorts and AUC, Atlantis and AUC for the breaking of the sidewalk and AUC against government for breaking the wall.
